This week’s case of the week comes from Cardiff County Court where a Judge found in our client’s favour following an accident in the street.

The local council had been undertaking a regeneration project which involved digging up the path leading up to the client’s front door and creating a trench. A temporary path was created to use.

Our client, in trying to navigate the area ended up tripping and falling into the trench in the course of which she was injured.

The Council denied they were to blame and when the case reached court the Judge found that the temporary footpath was unsafe, and the site represented a hazard.

Commenting on the case after the trial, the Thompson’s lawyer dealing with the case Caragh Hogan said: “Our client had no option but to try navigate a dangerous path, and in doing so was injured.  All of this could have been avoided had the Council thought through what would have made the area safe.”
