A motorcyclist who was thrown from his bike after being hit by a driver who failed to stop at a give-way sign has received a significant compensation payout to help fund his ongoing care and rehabilitation needs. 

Mr. James Topping, 78, a retired welder from Burscough, Lancashire, was out riding on the 18th of May, 2020, when the collision occurred at a junction on Tollgate Road.  

As the driver pulled out in front of his bike Mr Topping, known affectionately as Jim to his friends and family, slammed on the brakes and tried to swerve around the front end of the vehicle. However, the car continued to move forward, and he collided with the rear passenger door. 

Although traveling at the speed limit of 30mph and wearing a helmet, Jim sustained multiple physical and psychological injuries because of the crash which continue to impact him even now, including a fractured nose and thumb, multiple fractured ribs, and significant damage to his feet, knee and lower back.  

Police attended the scene, and the driver was later prosecuted for driving without due care and attention. 

Following his ordeal, Mr Topping instructed road traffic collision experts at Thompsons Solicitors through his union membership with Unite to investigate the circumstances surrounding the crash and to bring a legal claim for compensation.  

His legal team, led by Helen Templeton from the firm’s Liverpool office, was able to secure a significant five-figure payout for him in an out-of-court settlement which will help to fund his ongoing rehabilitation, therapy and physiotherapy needs moving forward.  

Thanks to his Unite membership Mr Topping received his compensation in full.
