  1. What is Essure? 

Essure is a permanent, non-surgical form of birth control used to sterilise women. Performed under general anaesthetic, medical practitioners insert a coil-like implant into the fallopian tube via a narrow telescopic apparatus being passed through the vagina and cervix. Once in place, the implant encourages fibrosis – or the development of scar tissue – which blocks the fallopian tube and prevents eggs from reaching the womb. 

Essure was first approved in the United States by the Food and Drug Administration (FDA) in 2002 before being approved for use in the UK by the National Institute for Clinical Excellence (NICE) in 2009.  

  1. How has Essure affected women? 

Essure has caused much controversy among global industry experts who have raised serious concerns over its safety and the high risks it poses.  Thousands of women in the UK and US have claimed the implant has led to them suffering a host of complications including: persistent abdominal pain; irregular periods; perforation of the uterus or fallopian tubes due to implant migration; allergies; hypersensitivity; headaches and fatigue. 

A study published by the British Medical Journal (BMJ) in 2015 found women with the implant were 10 times more likely to need a second operation, compared to those who had other forms of sterilisation. It was also linked to a further 21 re-operations out of 1,000 patients undergoing surgery. 

In the 13 years since Essure has been available in the US, there have been more than 5,000 complaints from women implanted with the device, with a shocking number of serious complications being reported. These include damage to internal organs, fatality by infection and foetal deaths. 

A number of personal injury claims for medical negligence have been filed against Essure manufacturer Bayer in the US, with an increasing amount of UK women now stepping forward to pursue medical negligence compensation claims.  

  1. Why is Essure still available if it has a high risk of complications? 

Essure is currently available on the NHS, however Bayer has confirmed it plans to remove Essure implants from the UK marketplace from 1 September 2017. Bayer maintains that the implant is safe, however the UK's Medicines and Healthcare products Regulatory Agency (MHRA) is monitoring the issue and suggests women affected by Essure report it on their website

  1. I’ve received the Essure implant and it’s causing me discomfort. What should I do? 

If you or a loved one is suffering from complications such as abdominal pain, irregular periods, allergies, fatigue or more serious issues such as perforated fallopian tubes, and you have had an Essure implant, you should visit your GP as soon as possible. Your GP should investigate whether the implant is the cause of your difficulties and if so, evaluate whether removal of the implant is necessary.

  1. How long do I have to make a compensation claim? 

You have three years from the date of an incident or injury to make a personal injury compensation claim. In medical negligence compensation claims, the time limit for lodging a claim is usually three years from the date of diagnosis or point at which you were told your medical treatment had been responsible for harm. However, this rule varies in some circumstances, so we recommend contacting our personal injury team for professional advice.
