Our client was walking home at night through an area with no street lighting when he lost his footing and fell into a partly-dug trench. Barriers were not properly erected around the trench at the time and there were no warning signs.

The contractors denied responsibility but a trial Judge held that had there been proper barriers around the area our client’s accident would not have occurred.

Donna Simcock, from Thompson Solicitors’ Stoke office, said: “Our client did not want to fall over and sustain the injuries he did. He was injured because basic barriers and signage weren’t there. This was an avoidable accident that the contractor tried to get out of.”
