Both claimant’s suffered food poisoning after eating a Chinese takeaway. Investigations showed they had contracted salmonella. The defendants alleged insurers repudiated on the basis that they said they were never on cover. The defendants applied to be struck off the Companies House register. They did not respond to the claim and were not represented at the hearing.

The first claimant had made a full recovery within six weeks and was awarded £1,750 general damages. The second claimant took eight weeks to recover and was awarded £1,850 general damages.
