Who can make a claim against a nursing home for negligence?

What is nursing home negligence?
Nursing home negligence is where you, or a relative, sustained an injury or harm because the nursing home breached its duty of care and acted negligently.
Injuries sustained in care homes often include:
- Slips, trips and falls – these may amount to negligence if the nursing home had not completed or followed a resident’s individual care plan designed to minimise the risk of falls.
- Careless handling resulting in injury or broken bones
- Wrong medication being given or over medication
- Neglect through matters such as inadequate meeting of special dietary needs, not calling a doctor when necessary or failing to perform certain tasks. Neglect can also include a negligent lack of supervision and allowing a vulnerable resident to wander from the nursing home
- Abuse - physical, emotional or psychological abuse
When looking at whether a nursing home may have been negligent, we look at your care plan (or your relatives) to see if the plan was adequate given the circumstances. We will also check that the plan was reviewed as required and if the nursing home had adequate policies and procedures to meet the care needs.
